It's a massive understatement to say that CCTV has become a major part of our lives. The UK is one of the most surveilled nations in the world, it's estimated that there is one camera for every 11 people. It's estimated that in London alone there are 500,000 CCTV cameras dotted around the city. This means that the average Londoner is caught on camera around 300 times a day. However, the shocking CCTV statistics don't end there, there's an estimated global 25 million CCTV cameras in the world, around 4 million of which are in Britain alone. This means that we have a higher number of cameras per capita than any other European country, and the Wandsworth borough in London has more CCTV than Boston, Dublin, Johannesburg,and San Francisco combined.

However, with regards to the intrusive actions of capturing and recording people's actions, it's important to consider the strict GDPR Data Protection laws. After all, according to GDPR, users of CCTV technology need to consider if their use is legitimate and proportionate.Whilst these cameras can be great for deterring c rime and helping the driver to feel safer whilst at work (completely reasonable and responsible actions),continuous recording would also record vulnerable passengers, which causes a split in public opinion. After all, it's a battle of our privacy Vs our safety;how much of one are we willing to sacrifice for the other.

What About The Taxi Driver?

However,whilst many are considering the rights of privacy for the passenger, it's important to remember that the taxi driver's right to privacy is enshrined in GDPR law. Many local authorities across the UK have installed these cameras to combat crime; however the continuously running camera systems are active even when the driver is using the taxi privately. Whenever they use their vehicle in their day-to-day lives, it will be recording. This could include things like picking their children up from school, taking elderly relatives to the shops,or travelling on holiday with their family.

The Law And Taxi CCTV?

According to GDPR, the collection of personal data must be done so for a specific purpose and in a proportionate manner. This means that if CCTV cameras recording whilst the driver is using the vehicle for personal or domestic purposes, it's likely that the recordings are unlawful, not just with regards to data protection legislation, but also according to the ICO, and in breach of Article 8 of the Human Rights Act 1998.

So, with this information, it might be surprising to learn that in February this year, it was reported that Taxis and minicab drives across England and Wales could be forced to install CCTV in their vehicles by the government. This is because a DfT review of taxi and private hire vehicles resulted in a report which called for CCTV in all cabs, arguing that it could deter abuse, fare evasion, and protect passengers. Currently only around 3% of local authorities in the UK require the mandatory inclusion of CCTV in taxis, so the majority of UK areas don't currently require the installation of CCTV cameras in private hire vehicles.
